政府建議訂立附屬法例，以清楚述明在《香港國安法》和《維護國家安全條例》下，界定「特區的法律下其他危害國家安全的罪行」的機制。律政司司長林定國強調，附屬法例沒有增加新的刑事罪行、沒有改變任何罰則，也沒有建立任何新制度。 林定國與保安局局長鄧炳強今日出席立法會保安事務委員會和司法及法律事務委員會聯席會議，介紹根據《國安條例》訂立附屬法例的立法建議，其後會見傳媒。 林定國表示，危害國家安全罪行不單包含《香港國安法》及其實施細則，以及《國安條例》所規定的罪行，也包括香港法律之下其他危害國家安全的罪行。 至於如何斷定某罪行是否危害國家安全的罪行，林定國說，當局希望更加清晰化。他指出，《香港國安法》和《國安條例》清楚說明有行政長官證明書的機制，即行政長官有權發出證明書，以判斷某些事情是否涉及國家安全，而此證明書對法院有約束力。 他說，是次訂立附屬法例的目的，就是清楚說明行政長官證明書的安排和機制，適用於判斷某一宗個別案件須被視作危害國家安全的罪行。 鄧炳強表示，附屬法例可令國安罪行相關規定在實施時更具確定性，沒有改變《香港國安法》、《國安條例》等適用於危害國家安全罪行的規定。 他重申，附屬法例沒有訂立新罪行、新罰則或新權力，也不影響一般市民生活、機構和組織的正常運作，奉公守法的人完全不會受到附屬法例影響。
