律政司司長林定國今日在海南出席2026海南自由貿易港法律周，推廣香港專業服務優勢，深化瓊港在法律和爭議解決服務方面的合作，助力兩地以「雙港聯通」之勢，貢獻國家高質量發展。 林定國在開幕式上致辭時表示，瓊港關係密切、人緣相親、商緣相連。他指，在國家十五五規劃時期，海南將加強涉外法治建設，打造海南自由貿易港國際商事糾紛解決「優選地」；香港則會深化國際法律和解決爭議服務中心建設、發揮專業服務優勢協助內地企業「走出去」，以及打造國際高端人才集聚高地。 他又指，香港所匯聚的人才可以自身所長，服務海南所需，助力海南優化法治營商環境。海南肩負發展商業航天新興產業的國家戰略角色，香港可就航天發展商業化提供適切的法律和專業服務支撐。他鼓勵海南以至全國的航天企業選擇香港法律作為合同的適用法律，並選擇香港作為多元化爭議解決的地點。 在儀式上，林定國與海南省司法廳廳長邱利軍簽署法律服務領域合作安排，深化律政司和海南省司法廳在推動瓊港法律服務合作、涉外法治人才培訓和交流等方面的工作。林定國隨後出席推進落實合作安排的座談會，並與海南省司法廳領導和海南省律師協會代表會面。
Secretary for Justice Paul Lam today attended the 2026 Hainan Free Trade Port Legal Week in Hainan. Mr Lam promoted Hong Kong’s strengths in professional services and sought to deepen co-operation in legal and dispute resolution between Hong Kong and Hainan, focusing on the idea of leveraging “connection of the two ports” as a means of contributing to the country’s high-quality development. Speaking at the opening ceremony, he remarked that Hong Kong and Hainan maintain close relations, supported by strong personal ties and business connections. During the period of the National 15th Five-Year Plan, Hainan will aim to strengthen its foreign-related rule of law and position the Hainan Free Trade Port as a preferred destination for resolving international commercial disputes. Mr Lam outlined that for its part Hong Kong will deepen its development as an international legal and dispute resolution services centre, leverage its strengths in professional services to assist Mainland enterprises in “going global”, and develop as an international hub for pooling high-calibre talent. He stressed that Hong Kong’s talent pool can help to serve Hainan’s needs and support the province in optimising its rule of law-governed business environment. The justice chief also highlighted that Hainan has a key role to play in developing commercial aerospace as a strategic emerging industry, adding that Hong Kong can provide tailored legal and professional services to support the commercialisation of aerospace development. He urged aerospace enterprises from Hainan and across the country to adopt Hong Kong law in their contracts and choose the city as a venue for diversified dispute resolution. At the ceremony, Mr Lam and Director-General of Hainan’s Department of Justice Qiu Lijun signed a co-operation arrangement to strengthen ties between the two places. The agreement covers legal services co-operation, foreign-related legal talent training, and mutual exchanges between Hong Kong and Hainan. Mr Lam subsequently attended an exchange session focused on advancing the arrangement’s implementation and met other leaders from the Hainan Department of Justice and representatives of the Hainan Lawyers Association.
政府今日在憲報刊登與落實《關於內地與香港特別行政區相互送達民商事司法文書的安排》相關的三項附屬法例。有關附屬法例明年3月30日實施。 三項附屬法例為《2026年高等法院規則（修訂）（第2號）規則》、《2026年區域法院規則（修訂）（第2號）規則》、《2026年婚姻訴訟（修訂）規則》。 律政司與最高人民法院今年4月20日簽署新安排，以完善內地與香港相互送達民商事司法文書的機制，進一步促進兩地法律制度的機制對接和規則銜接。 上述附屬法例旨在於香港實施新安排，而在內地，最高人民法院會就新安排的實施發布司法解釋。 律政司表示，相關附屬法例落實新安排，以增加向在內地人士送達民事法律程序司法文書的方式，推動跨境民商事案件及時高效審理，加強保障兩地當事人權益，更好地滿足兩地日益緊密的社會聯繫和司法需求。 三項附屬法例下周三提交立法會進行先訂立後審議程序。
Three items of subsidiary legislation relating to the implementation of the “Arrangement on Mutual Service of Judicial Documents in Civil & Commercial Proceedings between the Mainland & the Hong Kong Special Administrative Region” were published in the Government Gazette today. The three items are as follows: Rules of the High Court (Amendment) (No. 2) Rules 2026; Rules of the District Court (Amendment) (No. 2) Rules 2026; and Matrimonial Causes (Amendment) Rules 2026. All three will come into operation on March 30. The Department of Justice and the Supreme People’s Court (SPC) signed the new arrangement on April 20 this year, with a view to enhancing the mechanism for mutual use of judicial documents in civil and commercial matters between the Mainland and Hong Kong. The new arrangement also aims to further promote the alignment of mechanisms and rules between the legal systems of the two places. The subsidiary legislation seeks to implement the new arrangement in Hong Kong, while the SPC will promulgate a judicial interpretation of the new arrangement in the Mainland. The Hong Kong SAR Government and SPC have agreed that the arrangement will come into force on March 30, replacing an existing arrangement that has been in place for over 27 years. The subsidiary legislation will be tabled at the Legislative Council on October 21 for negative vetting.
